Phypen brain LLC ("we," "us," or "our") provides automated voice and SMS communication services to local businesses (the "Service"). This Privacy Policy describes how we collect, use, and protect personal information in connection with the Service. By using the Service, or by receiving communications sent through it, you agree to the practices described in this policy.
We provide our Service to businesses ("Clients") who use it to communicate with their own callers and customers ("End Users") — for example, sending an automatic text reply when a Client misses a phone call (missed-call text-back), sending a review request, sending an appointment-rebooking or reactivation reminder, capturing a lead, or sending an automated follow-up. We also prepare competitor and online-visibility audits for Clients; audits are business-analysis reports and do not involve messaging End Users. This policy covers both Clients who purchase the Service and End Users who receive messages sent through it.
When a business signs up for the Service, we collect business contact details (such as name, email address, business phone number, and billing information) needed to provide and bill for the Service.
To deliver messages on a Client's behalf, we process:
We automatically collect technical information needed to operate the Service securely, including IP addresses, device and browser information, timestamps, and error and diagnostic logs.
Consent. When an End User calls a business that uses our Service, or otherwise provides their mobile number to that business, they consent to receive automated text messages related to their call, inquiry, or relationship with that business — such as a missed-call text-back, a reply to their request, a review request, an appointment-rebooking or reactivation reminder, or a follow-up message.
Message frequency varies based on your interaction with the business. Message and data rates may apply.
Opt-out. You can opt out at any time by replying STOP to any message; you will receive one confirmation and then no further messages unless you opt back in. Reply HELP for help, or contact us at support@openbrain.my.
No sharing of mobile data. No mobile information — including phone numbers and SMS consent — will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are never sold, rented, or shared with third parties for their own use. We share information only with the service providers strictly necessary to deliver the messaging itself (such as our telecommunications carrier).
We do not sell your personal information. We do not share mobile opt-in or consent data with third parties for marketing. We do not use End User message content for advertising.
We use the following providers to operate the Service. They process data on our behalf and are contractually obligated to protect it:
Data is stored in a secure database and encrypted in transit using TLS/SSL and at rest where supported by our providers. While we take reasonable measures to protect information, no method of electronic storage is 100% secure.
We retain Client account data for as long as the account is active. Call and message records are retained as needed to provide the Service, support billing and dispute resolution, and meet legal obligations, and are then deleted or anonymized. IP addresses and server logs are retained for no more than 90 days.
Your information may be transferred to and processed in countries other than your own, including the United States.
The Service is not directed to children under 18, and we do not knowingly collect personal information from anyone under 18.
Subject to applicable law, you may request access to, correction of, or deletion of personal data we hold about you, and you may withdraw consent (for SMS, by replying STOP). California residents have rights under the CCPA/CPRA, including the right to know, delete, and opt out of sale — we do not sell personal information. EEA/UK residents have rights under the GDPR/UK GDPR, including access, portability, objection, and the right to lodge a complaint with a supervisory authority.

In the event of a data breach that compromises personal information, we will notify affected parties and authorities as required by applicable law.
We may update this Privacy Policy from time to time. We will post the updated policy at this address with a revised effective date. Continued use of the Service after changes constitutes acceptance of the updated policy.
